UN Working Group on Arbitrary Detention: Opinions on Chinese Cases

UN Working Group on Arbitrary Detention: Opinions on Chinese Cases

发布机构:联合国任意拘留问题工作组(WGAD)Issuing body: UN Working Group on Arbitrary Detention (WGAD) 意见期间:2015–2021年Opinions issued: 2015–2021 文号:A/HRC/WGAD/2020/82 等Symbols: A/HRC/WGAD/2020/82 et al.

Core finding: Through opinions on individual cases, the Working Group on Arbitrary Detention gives legal characterizations of specific persons' detention — whether it is arbitrary, which articles of the Universal Declaration of Human Rights it violates, and what remedy the government should provide. This page compiles the three most representative sets of its opinions on Chinese cases, filed by symbol and category.

1. What these documents are: the Working Group and its five categories

This page compiles not one document but a set of them: the legal opinions issued by the UN Working Group on Arbitrary Detention on specific Chinese cases. The Working Group is one of the special procedures of the UN Human Rights Council and is composed of five independent experts. It works differently from a treaty body: instead of reviewing States' periodic reports, it receives individual complaints, examines a specific case of detention, and issues an 'opinion' giving a legal characterization — whether this person's detention is arbitrary, on what basis, and what remedy the government should provide. Opinions are transmitted to the government concerned and published; anyone can retrieve the full text in the UN system by its symbol.

The Working Group decides whether detention is 'arbitrary' using a fixed framework of five categories. Category I: the detention has no legal basis at all — for example, a person is kept in custody after their sentence expires, or no law authorizes the detention. Category II: the detention results from the person's exercise of rights guaranteed by the Universal Declaration of Human Rights — freedoms of expression, assembly, association, religion and the like. Category III: the right to a fair trial has been violated so gravely as to give the detention an arbitrary character — for example, denial of access to a lawyer, secret trials, or evidence obtained by torture being admitted. Category IV: prolonged administrative detention of migrants and asylum seekers. Category V: detention that amounts to discrimination on grounds such as origin, ethnicity, religion or political opinion. One case can fall under several categories at once, and the more categories apply, the more complete the Working Group's negative characterization of that detention.

The legal force of the opinions must be stated exactly: they are not binding, and no body can open a prison gate directly upon them. Their weight lies in characterization — they are the most authoritative legal characterization of an individual case available within the UN system, made by independent experts applying published legal standards to the evidence in each case. A government may decline to implement an opinion, but it cannot plausibly claim the characterization does not exist: every opinion carries a symbol, an adoption date and an explicit mapping to articles, and remains in the UN record permanently, cited repeatedly by governments, rights organizations and researchers. This site files these opinions in their own section precisely because they offer something other than a court judgment: a formal conclusion on a named individual, written in the language of international law.

2. Core findings: what the three sets of opinions say

This page compiles three sets of opinions. The first is Opinion No. 82/2020 on Xu Zhiyong: the Working Group found that Xu had been deprived of his liberty arbitrarily, under categories I, II, III and V simultaneously, listed the articles of the Universal Declaration that had been violated, and asked the Chinese government to release him immediately and grant him compensation. The second concerns Ding Jiaxi, in two opinions six years apart: Opinion No. 3/2015 found the detention following his 2013 arrest arbitrary and asked for his immediate release; Opinion No. 30/2021, addressing his re-arrest at the end of 2019, found Ding Jiaxi, together with Zhang Zhongshun and Dai Zhenya, arbitrarily detained. The third is not a case outcome but a legal landmark: in Opinion No. 15/2019, the Working Group ruled in principle on the detention measure of 'residential surveillance at a designated location' itself, and on the wording of the offence in Article 105(2) of the Criminal Law. Together, the three sets cover the three typical products of the Working Group's China work: a characterization of an individual, a repeated characterization of the same individual, and a characterization of an instrument of the system itself.

One procedural detail is worth holding in mind when reading these opinions: before issuing an opinion, the Working Group transmits the complaint material to the government concerned, giving it an opportunity to respond; if the government does not reply, the Working Group may still issue its opinion — which is exactly what happened in the Xu Zhiyong case on this page. Government silence does not block a characterization procedurally; it simply means the opinion is filed in a state of 'no response from the government.' Another detail is the opinions' style: the Working Group never writes emotional condemnation, but proceeds in the order of facts, categories, articles and remedy, with requests usually comprising four elements — immediate release, an enforceable right to compensation, investigation and accountability, and amendment of the relevant law and practice. This site's account preserves that structure, so readers can see for themselves what each set of opinions actually requested, and which requests have had no sequel to this day.

3. Xu Zhiyong: Opinion No. 82/2020

The opinion on Xu Zhiyong carries the symbol A/HRC/WGAD/2020/82 — Opinion No. 82/2020 — and was adopted by the Working Group at its 89th session, held from 23 to 27 November 2020. The entry point to this site's own case record is the file at Xu Zhiyong; this section records only the content and procedure of the Working Group's opinion itself, without repeating his biography. In its conclusions, the opinion found that Xu Zhiyong's deprivation of liberty was arbitrary, falling under categories I, II, III and V at once — no legal basis, detention for exercising his rights, grave violations of fair-trial rights, and discrimination-based detention, four categories in a single case.

The opinion listed, article by article, the provisions of the Universal Declaration of Human Rights that had been violated: articles 2, 3, 7, 9, 10, 11, 12, 19, 20 and 21. Read together, these ten articles cover dignity and equality before the law, life, liberty and security of person, the prohibition of arbitrary arrest, fair trial, the presumption of innocence, privacy, freedom of expression, freedom of assembly and association, and the right to take part in public affairs. This site lists all ten without abridgement, because the list itself is the core information in the opinion: what the Working Group found was not a flaw in one procedural step, but a chain — from the basis of the arrest, to the fairness of the trial, to the very reason for the detention — that failed the Declaration's standards at every link.

The procedure must be recorded as it happened: on 1 July 2020 the Working Group wrote to the Chinese government seeking information on Xu Zhiyong's case; the government did not reply. With no response from the government, the Working Group issued its opinion on the basis of the material submitted by the source. Its request to the government was explicit: release Xu Zhiyong immediately and grant him compensation. Recording this procedural history matters because it determines how later readers should understand the opinion: this is not one side's account after a debate between two parties, but the formal record produced after the international procedure offered one party the opportunity to speak and that party declined it. If the government later calls an opinion 'one-sided,' the archive preserves alongside it the fact that it received the letter and did not answer.

4. Ding Jiaxi, Zhang Zhongshun and Dai Zhenya: two opinions and one legal landmark

Ding Jiaxi's name appears twice in the Working Group's record, six years apart, corresponding to his two arrests. The first time: in 2013 Ding was arrested in connection with the New Citizens' Movement; in Opinion No. 3/2015 the Working Group found his detention arbitrary and asked for his immediate release. That opinion was, in part, overtaken by events — Ding was released in 2016 upon completing his sentence. Note the precision of the archival wording: he was released 'on completing his sentence,' not 'released immediately' as the opinion had asked. The opinion demanded unconditional release; what actually happened was a sentence served to the last day. The distance between those two formulations is the most honest measure available of how such opinions are implemented. Ding Jiaxi's case file is at Ding Jiaxi.

The second time: after a gathering in Xiamen in December 2019, Ding Jiaxi was arrested again, together with Zhang Zhongshun and Dai Zhenya. The Working Group dealt with the case in Opinion No. 30/2021, symbol A/HRC/WGAD/2021/30, and found all three arbitrarily detained. That one person should be arrested twice within six years and twice found arbitrarily detained by a UN working group is itself an archival fact: the first opinion was issued, the sentence was served, the man was released — and then the same thing happened again in almost the same legal shape, and a second opinion followed. This site places the two opinions side by side in one section without commentary; readers can see for themselves whether the problem lies in the handling of individual cases or in the structure of the system. The two opinions give the same answer.

Alongside the case opinions stands the legal ruling in Opinion No. 15/2019; this site states only its legal conclusion and does not name the individual concerned in that opinion. In it, the Working Group found that the detention measure of 'residential surveillance at a designated location' in itself violates articles 6, 9, 10 and 11 of the Universal Declaration of Human Rights. The weight of the ruling lies in the words 'in itself': what the Working Group rejected was not an abuse in one instance of its use, but the proposition that holding a person at a place chosen by the authorities, cut off from ordinary detention oversight, can as an institutional arrangement meet the Declaration's requirements. The individuals in the Xu Zhiyong and Ding Jiaxi cases all passed through this form of detention, and the relevant paragraphs of their case opinions rest on exactly this legal basis.

The same Opinion No. 15/2019 also addressed the wording of an offence. The Working Group found that the crime of 'inciting subversion of state power' under Article 105(2) of the Criminal Law is a 'vague and imprecise offence' — those four words are the opinion's own — and called on China to repeal or amend the provision. The logic is a basic requirement of the rule of law: the boundaries of a criminal offence must be clear enough for an ordinary person to foresee the legal consequences of their conduct; an offence with blurred boundaries hands the whole power of judgment to the enforcer, making it impossible to distinguish lawful speech and conduct from crime in advance. Section 5 of this page will record that when Xu Zhiyong and Ding Jiaxi were sentenced in 2023, the charges were of precisely the 'subversion of state power' family — the Working Group's 2019 opinion on the offence itself and the judgments of four years later belong side by side in the archive.

5. Beijing's response and what followed the opinions

Beijing's position is relayed here objectively: the Chinese government has consistently stated that the cases in question were handled in accordance with the law, and that foreign and international mechanisms should not interfere in China's judicial sovereignty. As to the specific procedures on this page, the verifiable position is that in the proceedings leading to Opinion No. 82/2020, the Chinese government did not reply to the Working Group's letter of 1 July 2020. This site records both items side by side without reconciling them: on one side, Beijing's general stance of 'handled according to law, no interference'; on the other, the specific fact that it filed no response in this individual procedure. For its part, the Working Group, together with several human rights special rapporteurs, has over the years sent a large number of communications on Chinese cases, many of which the Chinese government did not answer — and, as the record itself indicates, that pattern is part of the record. This site files it as such: the list of communications, their dates, and whether they were answered are all checkable procedural facts, independent of either side's characterization.

The sequel must be written as it is, because it is the ultimate test of the opinions' weight. After the opinions above were issued, the Chinese government did not release the individuals concerned. In April 2023, following non-public trials, Xu Zhiyong and Ding Jiaxi were sentenced for 'subversion of state power' to 14 years and 12 years respectively. Lay the timeline out in full: in November 2020 the Working Group asked for Xu Zhiyong's immediate release; in 2021 it found Ding Jiaxi and the two others arbitrarily detained; in April 2023 what the two men received was not release but heavy sentences of more than a decade, under the very family of offences whose blurred boundaries the Working Group had already flagged, in trials that were not public. This site draws no conclusion for the reader; it pins each link of the timeline down by symbol and date: the opinions are there, the letters are there, the year of the judgments and the lengths of the sentences are there. The archive's duty ends here; judgment belongs to whoever reads the timeline.

6. Official texts and related pages

官方原文:许志永案第82/2020号意见全文见联合国官方PDF(A/HRC/WGAD/2020/82);丁家喜、张忠顺、戴振亚案第30/2021号意见全文见联合国人权高专办官方PDF(A/HRC/WGAD/2021/30)。 Official texts: the full text of Opinion No. 82/2020 on Xu Zhiyong is at the official UN PDF (A/HRC/WGAD/2020/82); the full text of Opinion No. 30/2021 on Ding Jiaxi, Zhang Zhongshun and Dai Zhenya is at the official OHCHR PDF (A/HRC/WGAD/2021/30). Opinions No. 3/2015 and No. 15/2019 can be retrieved in the UN document system by their opinion numbers. This site's account follows those originals; the opinions are legal texts, and the categories and articles in each case are ultimately governed by the conclusions of the originals.

Related pages on this site: the case files of Xu Zhiyong and Ding Jiaxi; and the sister file in this section, the Committee against Torture's Concluding Observations on China — the concern the Committee expressed in 2015 about 'residential surveillance at a designated location' and secret detention, and this page's Opinion No. 15/2019 ruling in law on the same detention measure, come from two different UN mechanisms four years apart, yet point to the same practice. Read together, the two pages show how the UN system's record on detention in China has accumulated year by year, each part corroborating the others. That is the reason this section exists: to take the characterizations buried deep in UN document stores, hard for ordinary readers to find, and place them one by one on an open archival shelf — with their symbols noted, their original links attached, and kept for the long term.
