Committee against Torture: Concluding Observations on China
Subject: China's fifth periodic report; considered at the Committee's 56th session on 17–18 November 2015 (1368th and 1371st meetings).
Document date: 3 February 2016; symbol CAT/C/CHN/CO/5, searchable in the UN document system.
Status: This remains the Committee's most recent review of China; China has not undergone a further review since, and its sixth periodic report is long overdue.
Context: The review took place a few months after the July 2015 '709 crackdown'; the Committee questioned the delegation about detained lawyers.
Core finding: The Committee recorded widespread reports of torture and ill-treatment in detention, the absence of independent investigation and continued reliance on confessions, and raised systematic concern about secret detention, 'residential surveillance at a designated location' and Party-run 'shuanggui' detention, all of which place people outside the protection of the law.
1. What this document is
This document is the formal review conclusion issued by the UN Committee against Torture on China's implementation of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment. States that join the Convention must report periodically to the Committee on the legislative, judicial and administrative measures they have taken to prevent torture. The Committee examines the report in public meetings, questions the State delegation, and then adopts 'concluding observations' setting out, item by item, what it welcomes, what concerns it and what it recommends. This page records the concluding observations on China's fifth periodic report.
The timeline of the review must be recorded item by item, because it determines the document's weight. The Committee considered China's report at its 56th session on 17 and 18 November 2015, at its 1368th and 1371st meetings. The concluding observations were adopted on 2 and 3 December 2015. The document itself is dated 3 February 2016 and carries the symbol CAT/C/CHN/CO/5. Readers wishing to check the original can locate it in the UN document system by that symbol; Section 6 of this page also gives the official link. Archival work depends on searchability and verifiability, and these dates and this symbol are this page's coordinates.
One fact that is easily overlooked must be stated plainly: these are the most recent concluding observations the Committee against Torture has issued on China. Since the 2015 review, China has not undergone a further review by the Committee, and its sixth periodic report is long overdue. In other words, this document, adopted at the end of 2015, remains the UN torture treaty body's most recent and most complete systematic assessment of detention and torture in China. How the detention system has evolved in the decade since is something the Committee has had no opportunity to review again at the same scale — and that gap is itself part of the background against which this document must be read.
Finally, a note on how this page is written. Concluding observations are a legal document: dense in paragraphs and strict in terminology. This site's task is not to copy the original but to relay it faithfully in our own words: what the Committee was concerned about, on what basis, and what it recommended China do, arranged item by item following the document's own structure. Only a few very short, emblematic phrases are quoted, with their sources noted. Where individual cases and events are involved, this page links to this site's existing case and event files, so that readers can read this overall assessment alongside the specific people and events it concerns.
2. Core findings
The Committee's core conclusion can be summed up in one sentence: although China's written law now contains rules prohibiting torture and excluding illegally obtained confessions, the reports before the Committee showed that torture and ill-treatment remained widespread at the detention stage, with no independent and effective mechanism to investigate allegations and hold perpetrators accountable. The problem, in other words, lies less in whether rules exist on paper than in the gap between the rules and detention practice: whether a detainee can see a lawyer promptly, whether the family is notified, whether interrogation is independently supervised, and whether a torture allegation is investigated by a body independent of the one accused. The Committee raised its questions at precisely these points, item by item.
Directly connected to this was the Committee's concern that the justice system still relied on confessions. Where confession is the central piece of evidence, interrogators have a strong incentive to extract admissions of guilt, while a detainee held incommunicado can neither refuse nor easily complain afterwards. The Committee therefore stressed repeatedly that excluding confessions obtained by torture must not remain a rule in the statute book: such confessions must actually be excluded in real cases, and judges and prosecutors confronted with a torture allegation have a duty to examine how the confession was obtained, rather than shifting the burden of proof onto the person in custody. This logic runs through the entire concluding observations and is the key to the specific concerns that follow.
The Committee also recorded a positive aspect, which this site notes in full, in keeping with archival practice: the document welcomed the rules established by the 2012 revision of the Criminal Procedure Law — confessions obtained by torture or other illegal methods are to be excluded, and interrogations in major cases are to be audio- and video-recorded. The Committee treated this legislative step as progress, while pointing out that once such rules exist, the key question is enforcement: whether recordings are complete, whether the defence can obtain them, and how many applications to exclude illegal evidence actually succeed in practice. Praise and concern in the same document is the normal pattern of treaty-body review: what is assessed is not a political stance but the actual state of a State party's compliance with its obligations.
In one of the document's most closely watched passages — paragraph 50 — the Committee addressed organ transplantation and organs from executed prisoners. This site relays it here in its own words, without reproducing the passage at length: on the one hand, the Committee welcomed China's ending of the practice of removing organs from executed prisoners without consent; on the other, it expressed concern that there was no independent oversight of whether such 'consent' was genuine. Its recommendation was that China should commission an independent investigation into allegations that Falun Gong practitioners may have had their organs removed. A single recommendation containing welcome, concern and a concrete demand at once is the characteristic style of concluding observations; this site records all three elements together, neither trimming nor amplifying any one of them.
3. What it documents
The first theme is secret detention and 'residential surveillance at a designated location.' The Committee's concern was that, in practice, this form of detention can keep a person outside the ordinary protection of the law for a considerable period: the person is not held in a detention centre, the family may not know where they are, lawyers have difficulty meeting them, and both custody and interrogation proceed outside the line of sight of routine supervision. The Committee's position was that every form of detention must have a clear legal basis, time limits and judicial oversight, and that a detainee's contact with the outside world — family, lawyer, doctor — must not be hollowed out by the very form of the detention. What a measure is called does not matter; what matters is whether the person held under it can still reach the law.
The second theme is 'shuanggui,' detention run by the Party's internal disciplinary system. The Committee noted that this system operates outside the framework of State law: a person subjected to shuanggui is taken away and investigated at a designated place, with no basis in criminal procedure law and none of its safeguards — no judicial review, no access to a lawyer, no notification of family. What concerned the Committee was the very existence of this extra-legal detention: when a person is held inside a system outside the law, the entire apparatus of protection against torture — records, supervision, complaints and accountability — has nothing to attach itself to. This site here only relays the Committee's characterization: it is a systemic concern expressly recorded in the document, not an allegation about an individual case.
The third theme is the situation of lawyers and rights defenders. The review took place in November 2015, only a few months after the '709 crackdown' of July that year, in which large numbers of rights lawyers and activists were detained or disappeared; during the review, the Committee put questions about the detained lawyers directly to the Chinese delegation. The concerns it recorded included the risk that lawyers handling sensitive cases face torture, ill-treatment and retaliation, the obstruction of lawyers' access to their clients, and what it means for the whole line of legal defence when those whose profession is defending rights become targets themselves: if the people who defend detainees can themselves be detained, every safeguard written into concluding observations is weakened at its source.
The fourth theme is Tibet and Xinjiang. The Committee recorded reports of torture and of deaths in custody from both regions and expressed its concern. Such passages in the document are typically written in general terms: the Committee describes the nature of the reports before it and the types of places involved, and asks the State party for information on investigations and statistics. Readers should note the evidentiary form of these paragraphs: they are not the Committee's factual findings on any single death, but a treaty body's formal concern based on reports from multiple sources, together with its demand that the State explain and investigate. Marking the level of a concern clearly is a basic requirement if an archive is not to mislead its readers.
The fifth theme is the death penalty. The Committee raised two points of concern: first, that death-penalty data are not made public, so the numbers of sentences and executions each year cannot be verified, and treating the figures as a state secret deprives any discussion of the penalty's scope of its basic facts; and second, that death-row prisoners were kept shackled around the clock during detention, which amounts to an additional punitive measure imposed on a person in custody. The Committee's interest in the death penalty connects directly to its mandate against torture: detention conditions, treatment before execution and the family's right to information all fall within the prohibition of cruel, inhuman or degrading treatment. This site relays the document's points as made, without extending them into a general discussion of abolition that the document itself does not conduct.
The sixth theme covers coercive measures in the enforcement of family-planning policy, and the treatment of petitioners. The Committee recorded reports of coercive measures used in enforcing family-planning policy — measures directed at intervening by force in individuals' bodies and reproductive decisions. It also expressed concern about petitioners: petitioning is the lawful channel through which ordinary people in China appeal grievances to higher authorities, yet reports before the Committee showed petitioners being held in unofficial places of detention — commonly known as 'black jails' — or sent into compulsory psychiatric institutions. What these two kinds of places have in common is that neither appears on any register of the formal detention system: no records, no time limits, no channel of complaint, which makes such detention harder for the outside world to discover and verify.
The seventh theme is Hong Kong and the principle of non-refoulement. On Hong Kong, the Committee's concern was that the mechanism for complaints against the police lacked independence: complaints were handled within the police system itself, without investigation and adjudication by an independent body, an arrangement unlikely to command complainants' confidence. On non-refoulement, the Committee expressed concern about returning people to countries where they might face torture, naming in the document the return of North Koreans and of Uyghurs. Non-refoulement is a hard obligation under the Convention against Torture: whatever a person's status or suspected offence, if there are substantial grounds for believing they face a danger of torture on return, the State party must not return them. The Committee placed these two items in the same conclusions because they test the same question: whether protections still work for the people they are least popular to protect.
4. Individual cases
Concluding observations are primarily an assessment of systems and do not adjudicate case by case, but every category of concern they record corresponds, in this site's archive, to specific people and events. This section gives internal links following the Committee's themes, to help readers move from the general assessment to individual cases. For the general file on persecution of religious believers, see this site's Falun Gong persecution file; paragraph 50's recommendation on organ removal should be read alongside that file to see why the Committee, while recording a 'welcome,' still insisted on an independent investigation of the allegations.
On the theme of lawyers and defenders, the review's immediate background was the July 2015 operation recorded in this site's 709 crackdown event file. Among the lawyers taken in that operation and long imprisoned afterwards, Wang Quanzhang's case file is at Wang Quanzhang; Gao Zhisheng, who long defended disadvantaged groups and believers and whose whereabouts have been unknown for years, is filed at Gao Zhisheng. This site makes only a thematic connection here, and does not rewrite the Committee's general concern as a ruling on these individuals: what the Committee questioned at the review was the situation of detained lawyers as a whole, and the details of each case rest on the sources in its own case page.
5. Beijing's response
In keeping with archival practice, this section sets out Beijing's statements at the review in parallel, with their sources noted and without adjudication. At the review itself, the Chinese delegation responded to the organ-related allegations: according to the UN meeting summary, the delegation described the claim that Falun Gong practitioners' organs had been removed as 'the utmost rumour.' This site quotes only that short phrase, and labels its nature clearly — it is the Chinese delegation's statement at the review, recorded in the UN meeting summary, not a finding of the Committee. At the same review, the delegation also stated that any organ transplant required the written consent of the donor. Readers comparing the two should note how paragraph 50, recorded in Section 2 above, is written: what the Committee welcomed was precisely the stated policy of ending removal without consent; what it remained concerned about was the absence of independent oversight of whether consent is genuine. The point of divergence between the two sides lies exactly at the step of independent verification.
On Tibet, the delegation stated at the review that there are no political prisoners in Tibet, and described allegations that suspects from ethnic minorities receive unjust treatment as groundless. Both statements likewise come from the delegation's replies at the review, and are relayed here in the terms of the meeting record. The procedural position must be recorded at the same time: after concluding observations are adopted, the treaty-body practice is for the State party to respond to the concerns and recommendations item by item in its next periodic report — and, as Section 1 noted, China's sixth periodic report is long overdue. That means Beijing's systematic written reply to this document has never appeared within the treaty-body procedure. The replies given at the review and the silence that followed are the two parts this section records together; neither is complete without the other.
6. Official text and related pages
Official text: the Committee against Torture's Concluding Observations on the Fifth Periodic Report of China, symbol CAT/C/CHN/CO/5, available via the official UN document link; if the link fails, search the UN document system by the symbol 'CAT/C/CHN/CO/5.' This site's account follows that original, and readers may compare it paragraph by paragraph. The sister file in this section is the compilation of UN Working Group on Arbitrary Detention opinions on Chinese cases: one document is a treaty body's systematic assessment of a system, the other a special procedure's legal characterization of individual cases — read together, the two pages show the two forms in which UN mechanisms address detention in China.
Related pages on this site: the Falun Gong persecution file (to be read with paragraph 50's organ recommendation); the 709 crackdown event file (the review's immediate background); and the case files of Wang Quanzhang and Gao Zhisheng (individual cases under the lawyers theme). A final note on evidentiary terms: the Committee's expressions of 'concern' are a treaty body's formal position, not a judicial verdict; Beijing's replies are a party's statements within the review procedure. This site labels the two separately and preserves them side by side, so that readers can judge for themselves how much of this 2015 assessment remains unanswered today.
