On December 10, 2008 — the 60th anniversary of the Universal Declaration of Human Rights — 303 Chinese citizens published Charter 08, a manifesto with 19 demands for political reform, calling for an end to one-party rule and constitutional democracy. Lead drafter Liu Xiaobo was detained two days before publication, sentenced to 11 years in 2009, awarded the Nobel Peace Prize in 2010, and died in custody in July 2017 — the first Nobel Peace laureate to die in detention.

目录Contents

Background: China in 2008

2008 was one of the most dramatic years under Communist rule — and the direct soil from which Charter 08 grew.

Beijing Olympics (August). China hosted the Games under the slogan "One World, One Dream," aiming to project openness and confidence. Officials promised the Olympics would advance human rights; instead, authorities tightened control over dissidents, petitioners and foreign journalists before and during the Games, using "Olympic security" as a pretext for crackdowns.

Tibet protests (March). On March 10, large protests erupted in Lhasa and spread across Tibetan areas. Armed police crushed them; officials reported 22 deaths while overseas Tibetan groups put the toll far higher. Tibet showed the world another face of China's human-rights record.

Sichuan earthquake (May 12). The magnitude-8.0 Wenchuan quake killed nearly 70,000; shoddy "tofu-dreg" school buildings collapsed, killing thousands of students. Parents demanding answers about construction quality were suppressed; "tofu-dreg projects" became a censored term. Artist Ai Weiwei and others launched a citizens' investigation documenting the dead students' names.

Melamine milk scandal (September). Sanlu milk powder contaminated with melamine sickened hundreds of thousands of infants and killed at least six. The scandal exposed regulatory corruption and information封锁 (blockade): complaints dated to late 2007, but local officials suppressed them to protect the Olympics.

Global financial crisis. The crisis hit Chinese exports in late 2008; factories closed and migrant workers lost jobs en masse. Beijing's 4-trillion-yuan stimulus that November was allocated opaquely, deepening corruption concerns.

Through these events, a group of intellectuals, lawyers and rights defenders concluded that without political reform, such disasters would recur. They chose December 10 — the 60th anniversary of the Universal Declaration of Human Rights — to publish a systematic political reform program: Charter 08.

Who decided

Detailed timeline

Early–autumn 2008: drafting. Liu Xiaobo, Zhang Zuhua and others drafted the text, consciously borrowing the form of Czechoslovakia's 1977 Charter 77 — likewise an intellectuals' political program, likewise published on a major human-rights anniversary. Scholars and lawyers were consulted during drafting.

December 8, 2008: Liu Xiaobo taken. Two days before the planned publication, Beijing state-security police took Liu Xiaobo from his home, seizing computers and manuscripts. Authorities evidently knew the publication plan and tried to cut it off at the source.

December 10, 2008: publication. Charter 08 was published online as scheduled with 303 initial signatories — scholars, lawyers, writers, journalists, rights defenders and former officials across the country. It opened: "Freedom, equality and human rights are universal values of humankind; democracy, republicanism and constitutionalism are the basic institutional framework of modern politics."

December 2008–2009: signatures grow, crackdown begins. Signatures quickly grew to thousands, eventually exceeding 10,000 (overseas tally). Meanwhile authorities launched systematic repression: at least 70 of the original 303 signers were summoned and interrogated; domestic media were banned from reporting on the Charter or interviewing any signer; the blog platform Bullog.cn was shut down over its links to the Charter; journalist Li Datong and two lawyers were searched and questioned.

March 11, 2009: Havel's award. At the opening of Prague's One World human-rights film festival, former Czech president Václav Havel — himself a Charter 77 founder — personally presented the Homo Homini human-rights award to Liu Xiaobo and the Charter 08 signers. With Liu imprisoned, philosopher Xu Youyu, scholar Cui Weiping and lawyer Mo Shaoping accepted on his behalf — a symbolic echo across 32 years between the two charters.

June 23, 2009: formal arrest. After six months of residential surveillance, Liu Xiaobo was formally arrested for "suspicion of inciting subversion of state power."

December 23, 2009: trial. The Beijing No.1 Intermediate Court tried Liu in a hearing lasting about three hours. In his final statement, "I Have No Enemies," Liu declared he had "no enemies and no hatred."

December 25, 2009: 11-year sentence. The court sentenced Liu to 11 years' imprisonment and 2 years' deprivation of political rights for "inciting subversion of state power" — among the longest known sentences for that charge. The verdict cited Charter 08 and six of Liu's essays as evidence; calls for a "federated republic" and "establishing a Chinese Federal Republic" were deemed proof of "incitement."

Charter 08 has three parts — "Preamble," "Our Basic Concepts," "Our Basic Proposals" — with the 19 demands at its core. The table above lists all 19 in both languages.

Who executed

Execution chain: Beijing Public Security (detention/residential surveillance) → Beijing Procuratorate (arrest/indictment) → Beijing No. 1 Intermediate Court (trial) → Beijing High Court (appeal) → Jinzhou Prison, Liaoning → state-security/police harassment of signatories.

Scale: 303 first signers (December 9, 2008); 10,000+ online signatures (2009–2010); 13,000+ total (by June 2011, methodology unverified). Fellow signer Liu Xianbin got 10 years (March 25, 2011) for the same "inciting subversion" charge.

Liu Xiaobo's death: in June 2017, terminal liver cancer was confirmed; he was moved to a Shenyang hospital. US and German specialists jointly stated he must be transferred abroad urgently — contradicting the Chinese hospital's claim that they said "there's no better option abroad." Liu's own strong request to go abroad (Germany first choice) was denied. He died in Shenyang on the evening of July 13, 2017, aged 61 — the first Nobel Peace laureate to die in custody.

The Liu Xiaobo case

Per editorial direction, Liu Xiaobo's entry sits under Charter 08, not as a separate "prize" entry.

Liu Xiaobo (1955–2017), born in Changchun, Jilin, held a PhD in Chinese literature from Beijing Normal University, where he taught. During June Fourth 1989, he joined Zhou Duo, Gao Xin and Hou Dejian in the "Four Gentlemen hunger strike," among the last witnesses in Tiananmen Square; he was twice imprisoned after 1989.

December 8, 2008: Liu was taken by Beijing police two days before Charter 08's publication; computers and manuscripts were seized. June 23, 2009: formally arrested for "suspicion of inciting subversion of state power." December 23, 2009: tried at Beijing No.1 Intermediate Court in a roughly three-hour hearing. His final statement, "I Have No Enemies," declared: "I have no enemies and no hatred."

December 25, 2009: sentenced to 11 years' imprisonment and 2 years' deprivation of political rights. The verdict cited Charter 08 and six of Liu's essays — among the longest known sentences for that charge.

October 8, 2010: the Norwegian Nobel Committee awarded Liu the 2010 Nobel Peace Prize "for his long and non-violent struggle for fundamental human rights in China" — the first Chinese citizen to receive it. Beijing furiously condemned the award, summoned Norway's ambassador, and froze diplomatic relations with Norway (restored only in 2016). At the December 10 ceremony, an empty chair was left for Liu — one of the most famous images in Nobel history.

June 2017: Liu was diagnosed with terminal liver cancer and granted medical parole. July 13, 2017: he died at the First Affiliated Hospital of China Medical University in Shenyang, aged 61 — the first Nobel Peace laureate to die in custody. His widow Liu Xia remained under house arrest until allowed to leave for Germany in July 2018.

Who opposed

1. The signers themselves:

2. Liu Xiaobo's Nobel Peace Prize (October 8, 2010): "for his long and non-violent struggle for fundamental human rights in China." In Oslo, the medal and diploma were presented to an empty chair. Beijing censored the news, put Liu Xia under house arrest, suppressed supporters, and called it a "Western conspiracy"; a group of veteran party cadres published an open letter demanding political reform and constitutional free speech.

3. International responses:

Unlike earlier campaigns where no one questioned the verdict, Charter 08's "opposition" was the signing itself — 303 first signers and 10,000+ later names taking real-name risks. Liu's 11-year sentence, death in custody, and the Nobel empty chair make this the site's most complete "opponents leave their names" page. International opposition (2008–2018+) is second only to Falun Gong.

Repression & impact

Systematic repression of signers. At least 70 of the original 303 signers were summoned and interrogated. Guangdong activist Luo Yongquan was summoned twice in half a month for signing. Domestic media were banned from covering the Charter or interviewing any signer. Police searched and questioned journalist Li Datong and two lawyers.

Internet blockade. Authorities blocked all pages and discussions mentioning Charter 08. The blog platform Bullog.cn, linked to the Charter, was shut down. State media such as China.com.cn ran pieces claiming Charter 08 would destroy "the progress of Chinese society and the welfare of the people."

Official framing. Beijing initially kept silent about the Charter, rarely discussing it publicly. After the 2010 Nobel Prize, Xinhua openly attacked it, calling Liu's "incitement" a "real social harm." The Global Times in 2014 called the drafting of Charter 08 by Liu and other "radical intellectuals" an "open violation of the constitution."

International solidarity. The US, Germany, France, Taiwan and others condemned harassment of signers and endorsed the Charter. The Dalai Lama and other international figures expressed support. Hong Kong saw protests demanding Liu's release. Overseas figures including Yu Ying-shih, Ha Jin, Chen Yizi, Fang Lizhi, Hu Ping, Song Yongyi, Su Xiaokang, Wan Runnan and Wang Dan signed in support.

Historical significance. Charter 08 is the most important civilian political program in China since June Fourth 1989. It was the first systematic roadmap from "new constitution" to "transitional justice"; its 19 demands remain the basic consensus of China's democracy movement. Liu Xiaobo's sacrifice — the 11-year sentence, the Nobel Prize, death in custody — made him the most emblematic figure of China's human-rights movement. As the Nobel Committee put it: "Through the severe punishment meted out to him, Liu has become the foremost symbol of this wide-ranging struggle for human rights in China."

709"Lineage: From Charter 08 to the New Citizens Movement to "709"

Charter 08's 19 demands — especially freedom of association, free speech, and judicial independence — became an intellectual source for the following decade of civic resistance. From 2012, Xu Zhiyong's New Citizens Movement advocated "freedom, justice, love," demanding official asset disclosure and education equality; its Citizens' Pledge descends directly from Charter 08. The movement was crushed in 2013; Xu was sentenced to 4 years.

The "709" crackdown beginning July 9, 2015 targeted the very rights-defense lawyers who had defended Charter 08 signers and New Citizens Movement participants. Wang Yu, Zhou Shifeng, Wang Quanzhang and others had represented multiple cases involving charter signers. From Liu Xiaobo's 2008 arrest, to Xu Zhiyong's 2013 sentencing, to the 2015 lawyer detentions runs a clear chain of repression: first the thinkers, then the organizers, finally the legal defenders.
