1. Life and Academic Career
Benny Tai Yiu-ting was born in Hong Kong on July 12, 1964, to a family from Guangzhou, educated at Diocesan Boys' School, and took his law degree and postgraduate certificate at the University of Hong Kong in the 1980s, followed by a master's in law at the University of London (LSE). As a student he served as external-affairs secretary of the HKU Students' Union, in the same cohort as future Secretary for Justice Rimsky Yuen. After graduating he worked as a bills assistant in democratic leader Martin Lee's office and sat on the Basic Law consultative structures as a student representative; his undergraduate thesis examined applying "one country, two systems" to Taiwan, and he has said he was never naive about the difficulties of combining the two systems.
Tai taught for decades in the University of Hong Kong's Faculty of Law as an associate professor and served as associate dean from 2000 to 2008, researching constitutional and public law, the rule of law and religion, human rights and participatory democracy; his books include The Constitutional Path of Hong Kong and The Heart of the Rule of Law. A Christian, he published Faith and the Law in 2007 on the public role of Christians in a plural society. In 2001 the HKSAR government awarded him the Medal of Honour for promoting Basic Law and human-rights civic education — an honour the government revoked by gazette on June 10, 2022, when he had already spent over a year on remand in the 47 case. He was no outsider storming the system, but a scholar formed within it who spent his career studying its constitution — and his later fate unfolded inside that same system.
2. Proposing Occupy Central and the Umbrella Movement
On January 16, 2013, Tai published an article in Apple Daily proposing "Occupy Central with Love and Peace": if the 2017 Chief Executive election plan failed international standards for genuine universal suffrage, ten thousand citizens would occupy Central's arteries in non-violent civil disobedience, paralysing the financial district to exert pressure, with participants declaring in advance that they would bear the legal consequences. With sociologist Chan Kin-man and Reverend Chu Yiu-ming he formed the "Occupy Trio," spending over a year on deliberation days, a civil charter and a civil referendum. In June 2014 the State Council issued a white paper on "one country, two systems," and on August 31 the NPC Standing Committee adopted the "8.31 Decision," requiring Chief Executive candidates to win majority support from a nominating committee — denounced by democrats as fake universal suffrage — and the countdown to occupation began.
On the night of September 26, 2014, after a class-boycott rally, students stormed the East Wing forecourt of government headquarters ("Civic Square"); police arrested many and used pepper spray. In the early hours of September 28, Tai announced at Tamar that Occupy Central was starting ahead of schedule; that afternoon police fired 87 tear-gas canisters, and the occupation spread to Admiralty, Mong Kok and Causeway Bay, becoming the 79-day Umbrella Movement. Tai's influence waned as students and citizens took the lead, and his calls to withdraw went unheeded. On December 3 the Occupy Trio surrendered at Central Police Station, acknowledging offences such as taking part in an unauthorized assembly; police recorded their details and let them leave without immediate charges. The sites were fully cleared in mid-December and the movement won no concessions, but "civil disobedience carries legal consequences" had been Tai's stated position from day one — a fact that formed the unavoidable backdrop to his later trials.
Tai's civil-disobedience advocacy came with a complete legal theory, which set him apart from ordinary activists. From 2013 he argued in print and lectures that civil disobedients do not despise the rule of law: they break a law openly, non-violently and willingly accepting punishment, to show that an institution fails the constitution's promise of universal suffrage — "breaking the law to achieve justice," bearing the penalty to draw society's attention to an unjust system. His 2013 book Occupy Central: The Peaceful Resistance War Room set out the reasoning, steps and risks in full. The movement's deliberation days, its civil charter and the June 2014 civil referendum run by academic groups (nearly 800,000 votes, mostly backing a plan with civil nomination) all followed that script. Precisely because every step was documented in public, prosecutors later needed no detective work: they only had to line up his own articles, interviews and press-conference remarks in chronological order to have a complete case — his transparency became the prosecution's most convenient evidence.
3. The Occupy Nine Case: 16 Months
Prosecution came more than two years after the movement ended. In March 2017 police informed the Occupy Trio and six others — Tanya Chan, Shiu Ka-chun, Tommy Cheung, Eason Chung, Raphael Wong and Lee Wing-tat, the "Occupy Nine" — by phone that they would be charged. The charges used the common-law offence of public nuisance: conspiracy to commit public nuisance, incitement to commit public nuisance, and incitement to incite public nuisance, carrying up to seven years — heavier than comparable statutory offences. Amnesty International criticized the use of vague common-law charges against peaceful protesters, noting the evidence included newspaper articles, press-conference remarks and media interviews from months before the protests. The trial opened in November 2018 at West Kowloon Magistrates' Courts, sitting as the District Court.
On April 9, 2019, Judge Johnny Chan convicted all nine on some or all charges; on April 24, Tai was sentenced to 16 months — the heaviest of the nine — for conspiracy to commit and incitement to commit public nuisance; Chan Kin-man also received 16 months, Chu Yiu-ming 16 months suspended for two years, and the rest community service or suspended terms. Tai went straight to prison, serving at Shek Pik Prison. On August 15, 2019, after about four months inside, he was granted bail of HK$100,000 pending appeal, leaving prison still affirming the philosophy of civil disobedience. Public reporting says little about the appeal's final disposal and how the balance of the Occupy sentence was handled; what is certain is that the case never turned in his favour afterwards — from 2021 he was remanded in the 47 case, and when the government revoked his Medal of Honour in 2022 it cited, among other things, the Occupy conviction.
4. ThunderGo, Project Storm, the Primary Plan — and Dismissal by HKU
After the occupation, Tai turned to electoral engineering. In February 2016 he proposed "ThunderGo," strategic vote allocation to coordinate the non-establishment vote toward a Legislative Council majority in 2016. In April 2017 came "Project Storm," training newcomers for the 2019 District Council elections in hopes of a pro-democracy majority that could influence the Election Committee. In the 2019 District Council elections, democrats won a landslide on record turnout. In 2020, with LegCo elections approaching, he proposed "35+": the camp would hold primaries to coordinate candidates, aiming for over half of LegCo's 70 seats, then use the Basic Law power to veto the budget to force the Chief Executive to answer the "five demands"; if the Chief Executive dissolved LegCo and democrats won a majority again, the Basic Law would require the Chief Executive's resignation. On April 28, 2020, his Apple Daily article laid out a ten-step scenario from winning 35+ to foreign sanctions — an article that later became a core prosecution document in the 47 case.
The primary's operating details belong in the record too, because the court later examined them item by item to convict. The vote was administered by Power for Democracy, coordinated by Au Nok-hin and Andrew Chiu with assistance from Ben Chung, with over 200 polling stations across Hong Kong and an electronic system verifying voter identity against double voting; candidates signed a common platform, including the "Inked Without Regret" declaration initiated by the resistance bloc, confirming they would use legislative powers to press the government to answer the demands. The vote proceeded after the National Security Law had taken effect and Secretary for Security John Lee had publicly warned it might be illegal; over 610,000 ballots were cast in two days. The organizers stressed at the time that a primary was only a coordination device with no legal force, no different from primaries long used by all Hong Kong camps — an argument the court rejected wholesale, holding that the shared platform to veto the budget itself constituted a conspiracy to paralyse the government by indiscriminate veto.
The pro-democracy primaries were held on July 11–12, 2020, with over 610,000 citizens voting. On July 28, the University of Hong Kong's Council voted 18–2 to overturn its Senate's milder conclusion and dismissed Tai with immediate effect, stopping his pay; the Senate had found his Occupy conduct amounted to misconduct but not the "good cause" required for dismissal. Tai responded that the decision was not made by HKU but by forces outside the university acting through proxies, marking "the end of academic freedom in Hong Kong"; Beijing's Liaison Office praised the dismissal. International academics widely condemned the decision, and academic-freedom organizations noted that in the very month the National Security Law took effect, HKU had removed a scholar convicted over peaceful protest — a precedent for governing a university by external political standards.
5. The 2021 Mass Arrest, Remand and the ICAC Case
At dawn on January 6, 2021, the police National Security Department deployed about a thousand officers and arrested 53 primary participants across Hong Kong, Tai among them, on suspicion of "conspiracy to commit subversion" under the National Security Law. After over 30 hours in custody, he was bailed late on January 7 at Ma On Shan Police Station for HK$30,000, surrendering his travel documents. He told reporters that Hong Kong had entered a bitter winter with a strong, cold wind blowing, but he believed many Hongkongers would keep battling the wind in their own ways — words that became a footnote to his next years: on February 28, 2021, he and 46 others were formally charged with conspiracy to commit subversion and remanded in custody the same day. Bail was refused under the National Security Law's high threshold, and he has been held at Lai Chi Kok Reception Centre ever since, without freedom to this day.
While he was on remand, another prosecution followed. In July 2021 the Independent Commission Against Corruption charged Tai and two others over the 2016 Legislative Council election: through a company, Eggs Alliance Limited, they had placed six advertisements in Ming Pao and Apple Daily promoting ThunderGo, incurring election expenses of over HK$253,000, while Tai was neither a candidate nor an election expense agent — four counts of engaging in illegal conduct to incur election expenses. On April 25, 2022, he pleaded guilty to all four counts in the District Court, and on May 24 was sentenced to 10 months, served while already on remand in the 47 case for over a year. A legal scholar jailed for paying for strategy advertisements: whatever the technical merits, the case illustrated how, after 2019, the prosecution machinery combed through democrats' old files across the board.
On March 1, 2021, the 47 defendants were brought to West Kowloon Magistrates' Courts for mention; the bail hearing ran for four consecutive days, into the small hours each night, with one defendant collapsing in court and taken to hospital — the media called it a "marathon hearing." Chief Magistrate Victor So, a designated national-security judge, initially granted bail to 15 defendants, but the Department of Justice immediately sought reviews and the High Court then revoked bail for most of them one by one; Tai was never among those granted bail at all. He and over 30 co-defendants waited at Lai Chi Kok Reception Centre for two years — the case was committed to the High Court in 2022, repeatedly adjourned over committal and scheduling, and only opened in February 2023. For a person not yet convicted, those two years on remand were already punishment in substance, and Hong Kong's system offers no remedy for such prolonged pre-trial detention.
6. The 47 Case: Trial and the 10-Year Sentence
The 47 case is the largest political trial under the National Security Law. It was heard by three designated national-security judges (Andrew Chan, Alex Lee and Johnny Chan) sitting as the Court of First Instance, without a jury, at the West Kowloon Law Courts Building. Tai had pleaded guilty to conspiracy to commit subversion before trial, so he did not go through the 118-day contested trial of February 2023 to mid-2024, but his role became the central dispute at sentencing. The prosecution cast him as the initiator, organizer and designer of the "ten steps to mutual destruction," a "principal offender" in the gravest tier under Article 22 of the National Security Law (life imprisonment or ten years and above). The defence argued that Tai had genuinely believed the primary lawful before the law took effect — he was himself a legal scholar who had repeatedly said publicly during the primaries that the plan complied with the Basic Law — and his counsel proposed a sentence of two years in mitigation.
Mitigation was heard on June 25–27, 2024. The defence tendered letters including from HKU law principal lecturer Eric Cheung Tat-ming and former Basic Law Committee member Chen Hongyi, and a letter by Tai himself, recounting his decades promoting the rule of law and Basic Law education. In court, Judge Andrew Chan pushed back, noting that on the "ten steps" article the court had found Tai intended to overturn "one country, two systems." On May 30, 2024, the court had already ruled on the contested defendants: 14 of 16 convicted, two acquitted, with the judgment describing Tai as the brains and primary promoter behind the scheme. On sentencing day, November 19, 2024, large crowds and foreign consular staff queued outside West Kowloon court. The court ruled Tai a "principal offender," took 15 years as the starting point, deducted one-third for his timely guilty plea, and sentenced him to 10 years — the heaviest among the 45 convicted. The next heaviest, Owen Chow, received seven years and nine months; Joshua Wong received four years and eight months.
Most defendants in the case had been on remand since February 28, 2021, time that counted toward their sentences. Tai was no exception: arrested on January 6, 2021 and formally remanded at the end of February, he never left reception centres and prisons apart from the briefest bail. In court appearances during the trial he looked visibly thinner. In his mitigation letter and messages relayed from court he kept his consistent line: the primary was an exercise of Basic Law rights; he accepted legal consequences but did not accept that pursuing democracy was a crime.
7. Family and Support
Tai's family has been part of his journey of resistance. During the 2014 occupation, his elder daughter flew back from Australia on a same-day ticket to support him and wrote an essay, "My Father"; his second son looked after his daily needs in the occupied zone, and his youngest son visited too. At the 2019 Occupy sentencing, family and crowds of supporters waited outside court. Through more than three years of remand in the 47 case, family members visited the reception centre regularly and attended sentencing hearings. Like many political prisoners' families, they keep a low profile on camera and appear little in public reporting — a silence that is itself part of the pressure. Support from academia and the legal profession was more public: after the HKU dismissal, alumni and student bodies petitioned in protest; after the 47-case sentences, legal scholars in Hong Kong and abroad kept speaking out, arguing that treating a primary as subversion criminalizes the very budget-veto power the Basic Law grants the legislature.
8. International Response and Current Status (as of October 2026)
On the day of the 47-case sentencing, the US State Department condemned the sentences as politically motivated, saying the defendants had merely engaged in lawful and peaceful political activity and should be released; Britain, the EU and Australia also issued statements of concern, and the UN human rights chief's office expressed grave concern. Amnesty International and Human Rights Watch called the case a systematic reckoning with Hong Kong's civil society. Beijing and the Hong Kong government reiterated that the case was tried according to law and that the National Security Law had restored order. None of these statements changed any defendant's situation. For Tai personally, international academic attention has not ceased since the 2020 HKU dismissal: he appears on multiple rights organizations' prisoner-of-conscience lists and scholar-at-risk monitoring lists.
Set against the whole 47-case list, his position is clearer. From April 2025, the shortest-sentenced defendants in the case (four years two months to four years five months) began completing their terms and going home, including Claudia Mo, Sham Tsz-kit and Fung Tat-chun; through 2026 those sentenced to five to seven years will also be released in succession. Tai's ten years is the longest in the case, and having pleaded guilty he was not among the 2026 appellants — his release comes last of all. In other words, as society begins to speak of "the 47 defendants coming home one by one," the case's "principal offender" must still spend roughly five more years in prison — for having coordinated a vote that let citizens choose candidates.
As of October 2026, Tai remains in prison serving the 10-year sentence in the 47 case. Counting remand time from late February 2021, his nominal term runs to about 2031; but since the Safeguarding National Security Ordinance took effect in 2024, early release through good-behaviour remission for national-security prisoners requires an assessment that release would not harm national security — a bar tightened so substantially that there is no guarantee he will be released on time or early. In February 2026 the Court of Appeal dismissed the conviction and sentence appeals of 12 contested defendants in the 47 case (Tai, having pleaded guilty, was not among the appellants); for him the judicial process is essentially over. He is 62 this year — if a release day comes, he will be nearly sixty-seven.
Our Take
Tai's chain of cases is laid out in the open: 16 months for a 79-day peaceful occupation, 10 months for a handful of election-strategy advertisements, and 10 years for coordinating a primary in which 610,000 people voted. Three cases, three different charges, one trajectory — the scale of punishment tracks not the harm done but who the defendant is. He wrote articles, organized a primary and taught people to vote, every step in public and every step grounded in articles of the Basic Law. When exercising constitutional rights can itself be assembled into "conspiracy to subvert," what is being sentenced is not a person but the rights themselves. A scholar who studied a constitution all his life has been jailed for "subversion" by the very system he studied — that is not the rule of law triumphant; it is the rule of law used as a tool.
