Albert Ho
(1951–)Albert Ho Chun-yan (1951–)
Born December 1, 1951 in Hong Kong; solicitor admitted 1977; Justice of the Peace and notary public since 1988 (notary license suspended 7 years in November 2025 following conviction). Former chairman of the Democratic Party and vice-chair of the Hong Kong Alliance; a long-time participant in the June Fourth candlelight vigils. Former Legislative Council member.
Earlier arrests and sentences: arrested April 18, 2020 with 14 other democrats over 2019 "unauthorized assemblies." In 2021 sentenced in several cases — 10 months (June 4, 2020 vigil), 18 months (Oct 1, 2019 march), 16 months (Oct 20, 2019 march), mostly concurrent; 12 months suspended 24 months (Aug 18, 2019 rally).
Arrested in the Alliance case: on September 8–9, 2021, Ho was arrested by national-security police alongside Chow Hang-tung (Lee Cheuk-yan was already imprisoned); all three were charged with "inciting subversion." The Alliance had been investigated as an alleged "foreign agent" since August 2021; its assets were frozen, the June Fourth Museum raided, and the group forced to disband in September. Bail denied July 2022; granted August 2022 for lung-cancer treatment; bail revoked March 21, 2023, remanded since.
Guilty plea and sentence: pleaded guilty in January 2026; sentenced in September 2026 (alongside Lee and Chow) to 5 years and 2 months. Judges likewise cited the "end one-party dictatorship" slogan. Aged 74, Ho received the shortest term of the three.
Key sentence: September 2026 — 5 years 2 months for "inciting subversion" (guilty plea). Currently serving.

(1951—2019)1. Lawyer and Legislator (1951–2019)
Albert Ho Chun-yan was born in Hong Kong on December 1, 1951. He took a law degree at the University of Hong Kong, qualified as a solicitor in 1977, and practised with his own firm. From 1988 he served as a Justice of the Peace and a notary public. He came up through the Diaoyu Islands defence movement into party politics: co-founding the United Democrats in 1990, merging it into the Democratic Party in 1994, and chairing the Democratic Party from 2006 to 2012. Elected to the Legislative Council in 1995, he served as a legislator on and off for nearly twenty years to 2016, alongside years as a Tuen Mun district councillor (2000–2015), and was a senior figure in the pro-democracy camp on legal, security and human-rights questions.
Ho had a second identity in mainland rights circles: for years he chaired the China Human Rights Lawyers Concern Group, which supported and publicised the cases of persecuted mainland lawyers. In August 2006, after a protest march, he was beaten with sticks by several men inside a Central fast-food restaurant and hospitalised with head injuries; the attackers' motive was never established, and the assault became an early marker of violent intimidation against Hong Kong democrats. From 2014 to 2019 he chaired the Hong Kong Alliance, then served as its vice-chair until the Alliance was dissolved.
2. The Alliance and Thirty Years of Candles in Victoria Park
The Hong Kong Alliance in Support of Patriotic Democratic Movements of China was founded in May 1989 during the Beijing student movement. Its five operational goals were: release democracy activists, vindicate the 1989 movement, hold those responsible for the killings to account, end one-party dictatorship, and build a democratic China. From 1990 the Alliance held a candlelight vigil in Victoria Park every June 4 — the world's largest Tiananmen commemoration, drawing some 180,000 people in 2019. Ho was one of its thirty-year organisers: reading the eulogy on stage, handling police liaison and legal risk off it.
On June 30, 2020, the Hong Kong National Security Law took effect. In both 2020 and 2021 police banned the Victoria Park vigil citing COVID-19 — the first bans in thirty-one years. Alliance members still came individually with flowers and candles; many were later charged with 'incitement' or 'taking part in an unauthorised assembly.' Ho himself pleaded guilty and was jailed in the 2020 vigil case (below). Within two years, a memorial gathering protected by the Basic Law had become a chain of criminal cases.
3. 2020–2021: The Assembly Cases
On April 18, 2020, police arrested Ho together with fourteen other democrats, including Jimmy Lai and Martin Lee, over a series of 2019 marches, charging them with organising or joining 'unauthorised assemblies.' Over the following two years Ho was sentenced in four cases: twelve months suspended for twenty-four months for the August 18, 2019 rally; eighteen months for the October 1, 2019 march; sixteen months for the October 20, 2019 march; and, after a guilty plea, ten months for the June 4, 2020 vigil. With terms largely running concurrently, he entered prison in May 2021.
The cases shared a pattern: every march prosecuted had been peaceful, with no violence and no arrests made at the time; the prosecutions arrived in a batch only after the National Security Law changed the political weather. Across the cases Ho pleaded guilty or was convicted after trial. After forty years as a lawyer, he stood as a defendant in courts he knew well — a point he noted wryly in mitigation.
Taken together, the four cases gave Ho nominal sentences totalling over four years for peaceful assembly, of which, with terms running concurrently and overlapping his national-security remand, he served about twenty months. The mass arrest of April 18, 2020 drew immediate international attention: the fifteen arrested included the 82-year-old founding chairman of the Democratic Party, Martin Lee, and Britain, the United States and the EU all issued statements on the prosecutions' chilling effect. Over the next two years the organisers of the 2019 marches were tried and jailed case by case, batch by batch. Legal commentators widely noted that 'unauthorised assembly' under the Public Order Ordinance carries up to five years, and that systematically charging senior democrats with it for peaceful marches had the practical effect of sending the 2019 movement's leadership to prison one by one. Ho was midway down that conveyor when the far heavier national-security case reached him.
4. The Alliance National Security Case: From 'Foreign Agent' Demand to Charges
On August 25, 2021, the police National Security Department wrote to Alliance standing-committee members calling the Alliance a 'foreign agent' and demanding, under the National Security Law's Article 43 implementation rules, its membership lists, meeting records, finances and activity files by a deadline. The Alliance replied publicly: it was the agent of no foreign government or political organisation, and it would not comply. On September 7, vice-chair Chow Hang-tung and others delivered that refusal at police headquarters.
At dawn on September 8, national-security police arrested four Alliance committee members, including Chow Hang-tung. On September 9, Ho and Lee Cheuk-yan — both already in prison — were charged, with Chow and the Alliance itself, with one count of 'inciting others to subvert state power,' covering July 1, 2020 to September 8, 2021; the case became High Court HCCC 155/2022. The same day police raided the June Fourth Museum in Mong Kok, seizing exhibits and files, and froze some HK$2.2 million of Alliance assets. On September 25 an extraordinary general meeting voted to dissolve: after thirty-two years, the Alliance ended between arrests and an asset freeze, was later struck off the companies register, and was represented in the proceedings by the Official Receiver.
In the parallel data-refusal case, Chow Hang-tung, Tang Ngok-kwan and Tsui Hon-kwong were jailed for four and a half months. On March 6, 2025, the Court of Final Appeal unanimously allowed their appeals and quashed the convictions, holding that the prosecution had to prove the Alliance actually was a 'foreign agent,' and that heavy redaction of evidence under public-interest immunity had denied the defendants a fair trial. By the time of that victory the Alliance no longer existed, and the subversion case was still awaiting trial.
5. The Bail Struggle: Lung Cancer, Strict Conditions, Brief Release
Bail under the National Security Law is governed by Article 42: a judge may grant it only with sufficient grounds to believe the accused will not continue acts endangering national security. Bail applications by Ho, Lee and Chow were refused repeatedly in the magistracy and the High Court. In July 2022 Ho's application was refused again; in August, citing his age of seventy and lung cancer requiring continuing treatment, he applied once more, and Judge Esther Toh granted bail on stringent conditions: substantial cash bail and sureties, no departure from Hong Kong, surrender of travel documents, a curfew, no media interviews, no statements deemed to endanger national security, and no contact with specified persons. It was his first time out of custody since May 2021 — more than fifteen months.
On bail, Ho lived quietly, focused on treatment and his defence. The limited freedom lasted seven months. In March 2023 the National Security Department alleged that, while on bail, he had interfered with witnesses and perverted the course of justice, breaching his bail conditions.
6. March 2023: Rearrested, Bail Revoked
On March 21, 2023, National Security Department officers arrested Ho at his home. Media reports citing police sources said the arrest concerned alleged approaches influencing witnesses in the Alliance case; Ho's side did not publicly address the specifics. On March 22 he was brought to court, his bail was revoked, and he was remanded on the spot. He was seventy-one, his lung-cancer treatment unfinished. On March 28 the UN Office of the High Commissioner for Human Rights took the unusual step of commenting on an individual case, saying it was following his return to custody 'despite his critical health condition' with great concern and urging the authorities to release him so his urgent medical care could continue.
Ho was never released again. The witness-interference allegation was never, so far as public reports show, separately prosecuted; its practical effect was that a cancer patient was returned to prison over a bail-conditions dispute, and stayed there through trial and sentencing three and a half years later.
7. Years on Remand and a Trial Twice Delayed
Committed to the High Court, the Alliance trial was delayed again and again: listed for May 2025, put back to November 11, 2025, then to January 22, 2026. By late 2025 the three defendants had spent between roughly 1,300 and 1,500 days in custody — Lee and Chow never bailed since September 2021, Ho cumulatively remanded for over 1,300 days. A joint statement by Amnesty International's Hong Kong overseas section and other groups on Human Rights Day, December 10, 2025, noted that this pre-trial detention ran to more than four times the average in Hong Kong national-security cases, denouncing prolonged detention without conviction as a tool of suppression contrary to the presumption of innocence. During the delays, Ho indicated he would change his plea to guilty and negotiate agreed facts with the prosecution — after more than four years in the dock, the lawyer in his seventies chose to plead.
8. 2026: Trial, Guilty Plea, and Sentencing
On January 22, 2026, the Alliance trial opened at the West Kowloon Law Courts, sitting as the High Court's Court of First Instance, before three National Security Law designated judges — Alex Lee, Amanda Woodcock and Johnny Chan — with no jury. Ho pleaded guilty at the opening; Lee, Chow and the Alliance (represented by the Official Receiver) pleaded not guilty and stood trial. The trial ran about twenty-four days, with closing submissions completed in May 2026. The prosecution's core argument targeted one of the Alliance's five goals — 'end one-party dictatorship' — which it cast as aiming to overthrow the fundamental system established by China's constitution.
On August 21, 2026, the court convicted Lee, Chow and the Alliance; Ho stood convicted on his plea. The judgment held that 'end one-party dictatorship' meant ending the CCP's leadership as established under China's constitution, that 'end' carried the sense of overthrow and destruction, and that continuing to promote the goal after the National Security Law took effect could amount to 'other unlawful means.' The judgment also recorded that the case involved no violence or threat of violence, and that the defendants had put forward no concrete method or timetable for achieving the goal. Sentencing followed on September 11: Ho, with credit for his guilty plea, received five years and two months; Lee seven years; Chow seven years and three months; the Alliance was fined HK$1.5 million. The court placed the case in the 'serious nature' band, citing the unsettled social climate, fourteen months of activity and the defendants' wide reach. At seventy-four, Ho received the shortest term of the three.
9. Family, Health, and Professional Fallout
Ho's family has kept a very low profile for years. His wife, Tang Suk-yee, rarely appears in public; his children have never spoken on the case. His health — the lung-cancer history, treatment while on bail, medical arrangements on remand — is known only through scattered court and media reports; the family has never held a press conference. That silence is itself typical of Hong Kong national-security cases: relatives who speak to media risk drawing the National Security Department's attention.
Professionally, in November 2025 Ho's notary public licence was suspended for seven years following his convictions. A lawyer who had practised for more than four decades and defended countless clients saw his professional identities stripped one by one at the end of his career — Justice of the Peace, notary, legislator, party chairman, Alliance office-holder. The prison sentence was only the last link in that chain of removal.
10. International Response
International attention to Ho's case clustered at three moments. First, the March 2023 bail revocation, when the UN Human Rights Office publicly urged his release and rights groups condemned the re-imprisonment of a critically ill cancer patient. Second, the dragging pre-trial detention: Amnesty International's 2025 fifth-anniversary report on the National Security Law, 'The Government Can Imprison People, But It Cannot Imprison Their Thoughts,' used the Alliance case as an exemplar of punishment by procedural delay, and Amnesty joined legal and civil-society groups in demanding the three be freed. Third, the September 2026 sentencing: the UN Human Rights Office called the sentences 'regrettable,' its High Commissioner urging that the convictions be quashed and the National Security Law brought into line with China's international human rights obligations; the European Parliament condemned the sentences by 459 votes to 12 and called for sanctions on Chief Executive John Lee. Hong Kong Watch led its September 2026 human-rights briefing with the case.
11. The June Fourth Museum: From Tsim Sha Tsui to the Raid
The Alliance preserved memory in more than one night of candles. In 2014 it bought premises in Tsim Sha Tsui and opened the world's first June Fourth Museum, displaying artefacts, photographs and documents; in 2016, under pressure from the building's owners' corporation over use of the premises, the museum was forced to close. It reopened in Mong Kok in 2019. As Alliance chairman and vice-chair, Ho was among the decision-makers through founding, closure and reopening. When national-security police raided the museum on September 9, 2021, officers carried away display boards, exhibits and archives — a replica Goddess of Democracy statue among them — and the museum has never reopened. Exhibits removed as evidence of 'inciting subversion' and a slogan convicted in court are two faces of one policy: what is being policed is not conduct, but the vessels of memory.
The China Human Rights Lawyers Concern Group is the other thread of Ho's career. Founded in 2007 and long chaired by Ho, it organised international support for mainland lawyers — the '709' detainees, Gao Zhisheng, Li Heping and others — publishing reports and arranging overseas legal observers. In Beijing's eyes this cross-border support network formed part of the background to the 'foreign agent' label pinned on the Alliance — although the two were separate organisations, and although supporting lawyers was never secret. The Concern Group dissolved in 2021 alongside the Alliance. Both threads of Ho's forty-year career — Hong Kong parliamentary politics and cross-border human-rights advocacy — were cut in the same year.
12. The Institutions on Record
The institutions that acted in Ho's case, item by item: arrests and investigation by the National Security Department of the Hong Kong Police Force — the April 2020 mass arrests, the August–September 2021 data demand, arrests and raids against the Alliance, and the March 2023 rearrest. Prosecution by the Department of Justice's Prosecutions Division, national-security prosecutions requiring the Secretary for Justice's consent under the National Security Law. Courts in sequence: the Magistrates' Courts (bail and committal), the District Court (the 2021 assembly cases) and the High Court's Court of First Instance (the Alliance case, before three Chief-Executive-designated national-security judges, without a jury). Custody and imprisonment by the Correctional Services Department. The asset freeze was imposed by the Commissioner of Police under the Article 43 implementation rules. The suspension of Ho's notary licence followed from his conviction record through the Law Society and notarial authorities. Every link has a named institution and a paper trail — which is what makes this case an archive rather than an abstraction: not 'repression' in general, but a traceable series of administrative and judicial decisions.
13. Sentencing Day: Mitigation and Reaction
At sentencing, Ho's mitigation rested on three points: his age of seventy-four; his lung-cancer history and continuing health risks; and decades of public service — legislator, district councillor, Justice of the Peace, and unpaid legal and human-rights work. The court accepted the guilty-plea discount but stressed the case's 'serious nature' band, against which a public-service record weighed little. On September 11, supporters and former Alliance members filled the public gallery; Ho appeared grave, while Lee and Chow smiled towards the gallery. After sentencing, former Alliance member Lau Ka-yee and others outside court called the terms excessive and the convictions unjust; the families made no public response. Of the three, Ho alone was not reported to have appealed — for a defendant who pleaded guilty, a sentence appeal must show the term was manifestly excessive, a very high threshold.
11. Current Status (as of October 2026)
Albert Ho is serving his sentence of five years and two months, imposed on September 11, 2026, with his cumulative 1,300-plus days on remand credited by law; no official release date has been published. Lee Cheuk-yan and Chow Hang-tung have appealed their convictions and sentences. Ho, having pleaded guilty, could appeal mainly against sentence; as of October 2026 no appeal by him has been publicly reported. The Democratic Party he once chaired began dissolution procedures in 2025; the Alliance he served as vice-chair has been gone for five years; and the Victoria Park vigil he helped organise for thirty years has not been held since 2019.
Our Take
At the core of Albert Ho's conviction is a slogan shouted openly for thirty years. The court itself recorded that this case involved no violence, no threat of violence, and no concrete method or timetable for achieving the Alliance's goal. On six words — 'end one-party dictatorship' — and fourteen months of public activity, a 74-year-old lawyer with lung cancer received five years and two months, after more than 1,300 days already spent in custody, including three and a half years following a bail revocation based on a witness-interference allegation that was never separately prosecuted. To reclassify, retroactively, an organisation that operated openly and lawfully for thirty-two years as a crime, and commemoration as the prelude to subversion, is not the application of law. It is law used to ratify a political conclusion: that memory itself is guilty.
