(1991—2019)1. Education and Research: Migrant Workers, Pensions, First Activism (1991–2019)

Li Qiaochu was born on January 13, 1991 (her judgment records her birthplace as Yining, Xinjiang; English Wikipedia records Beijing — both are noted here). She took her bachelor's degree at Renmin University of China and a master's in public policy at the University of York in 2015. Back in China she worked as a research assistant at Tsinghua University on migrant-workers' rights and the pension system — pension unification, migrant workers' social-insurance contributions and portability were her subjects. Fieldwork took her into factories and urban villages: the 'migrant workers' of her research were not abstractions, but particular people.

Beyond research she moved into public action: during Beijing's November 2017 clearance campaign, when migrant workers were driven from their homes in midwinter, she volunteered in relief and documentation work; in 2018 she supported the #MeToo movement and the Jasic workers' attempt to form a union in Shenzhen, working where labour and women's rights meet. She met and became partners with legal scholar Xu Zhiyong, a leading figure of China's citizens' movement, jailed from 2014 to 2017 for founding the Open Constitution Initiative and campaigning for equal education rights. That relationship would later be written into her indictment as a core element of her crime.

2. The Xiamen Gathering's Shadow: The New Year's Eve Summons

In early December 2019, Xu Zhiyong, Ding Jiaxi and other citizens'-movement figures, lawyers and scholars held an informal gathering in Xiamen, Fujian, to discuss current affairs and civil society. From December 26 the authorities launched cross-province arrests — the '12.26 crackdown' — taking in participants and associates. Xu left Xiamen and went into hiding. On December 31, the last day of 2019, Li Qiaochu was summoned by the Beijing Public Security Bureau and held for twenty-four hours. The interrogation had a single theme: where is Xu Zhiyong? She refused to give his whereabouts; on release, her devices had been examined and police warned her explicitly not to speak out.

On January 9, 2020, Li published an online account criticising the summons and the threats, describing her own treatment in interrogation — her first public, real-name account of what the police had done. Five weeks after it appeared, they came for her. The sequence of dates is itself part of this case's record.

3. Designated-Location Surveillance: Four Months Disappeared

On February 15, 2020, Xu Zhiyong was arrested in Guangzhou. Hours later, in the early morning of February 16, Beijing police came to Xu's Beijing residence and took Li Qiaochu away. She was held under 'residential surveillance at a designated location' (RSDL) — a measure allowing secret detention outside the detention-centre system for up to six months: location withheld from family, no lawyer access, paperwork that need not be served. Her family received no formal documents; her lawyer, Song Yusheng, was told by the handling officers only that the case 'involved national security.' As the Chinese Human Rights Defenders network recorded at the time, in legal effect this was indistinguishable from enforced disappearance.

In January 2021, six months after her release on bail, Li published a long account of those four months in her own words. As she described it: held alone in a small room under round-the-clock light and surveillance, interrogated in rotation; her pre-existing depression deteriorated sharply, with symptoms including auditory hallucinations, while medical care and medication long went unsecured; guards and interrogators pressured her with Xu Zhiyong's safety and her family's situation. Her account is a rare real-name record of RSDL from the inside. When China underwent its UN Universal Periodic Review in January 2024, five states publicly called on it to abolish RSDL — Li's four months are one footnote to that institution.

On June 19, 2020, after 124 days of secret detention, Li was released on bail pending trial. Bail was not freedom: she could not leave Beijing, remained subject to summons at any time, and her case hung unresolved. What she did next was, in the authorities' eyes, unforgivable: she kept speaking — and she spoke for the imprisoned Xu Zhiyong.

4. Speaking Out on Bail, and the Second Arrest

Xu Zhiyong was held at the Linshu County Detention Centre in Shandong. Through the second half of 2020, Li used lawyers' visit reports and public channels to keep disclosing his conditions: inadequate food, restricted exercise and visits, suspected ill-treatment. In early February 2021 she posted on social media about the harsh conditions and torture allegations at Linshu and called for attention. Days later, on February 6, 2021, she was taken away again — this time not by Beijing police: she was transferred to Linyi, Shandong, her case folded into Xu Zhiyong's.

In March 2021 Li was formally arrested for 'inciting subversion of state power' and held in Linyi, at a detention centre and a police-run medical facility (per CHRD's records). On February 28, 2022, the Linyi People's Procuratorate indicted her. Per the indictment, her 'criminal facts' included: first, that she 'is Xu Zhiyong's girlfriend, deeply influenced by his subversive thinking'; second, that while Xu was detained she ran his blog and published his articles, thereby 'spreading subversive thought'; third, her own social-media posts. Amnesty International, reviewing the indictment, observed that using an intimate relationship and 'being influenced in thought' as grounds for conviction amounted to a form of punishment by association.

(2021—2024)5. Health and Family During Detention (2021–2024)

After her second arrest, Li spent nearly three years detained in Linyi before judgment. Her depression worsened steadily in custody; her family repeatedly conveyed, through rights organisations, their fears for her mental health and access to medication. Lawyer visits were long restricted and case information kept from the family. Her parents lived under continuous pressure: CHRD recorded as early as the 2020 RSDL period that official pressure had made the family hesitant even in communicating with her lawyer; after 2021 that pressure became permanent. On April 10, 2023, Xu Zhiyong was sentenced to fourteen years for 'subversion of state power' — by then Li's own case had been suspended in a Linyi detention centre for over two years.

Break her custody into segments: 124 days of RSDL in 2020; from February 6, 2021 to sentencing on February 5, 2024, exactly three years of pre-trial detention; after sentencing, prior custody was credited and her term expired on August 3, 2024. In an 'inciting subversion' case in the lesser band (maximum five years), the defendant spent three years locked up before judgment — before the trial began, most of the punishment had already been carried out.

6. The Trial Chain: Two Hearings and the 2024 Verdict

The public record carries two hearing dates for Li's case, both noted here: CHRD's case file records a trial date of June 20, 2023; Amnesty International reported a further hearing on December 19, 2023 at the Linyi Economic and Technological Development Zone People's Court, held behind closed doors on 'state secrets' grounds, with family and public barred. By then Li had been detained for nearly three years. Amnesty said on the hearing day that the authorities were using the trial to retroactively legitimise years of harassment and detention on evidence so thin it amounted to punishment by association.

On February 5, 2024, the Linyi Intermediate People's Court delivered judgment: Li Qiaochu was guilty of 'inciting subversion of state power,' sentenced to three years and eight months plus two years' deprivation of political rights, the term running from February 6, 2021 with all prior detention credited, expiring August 3, 2024. Li stated in court that she would appeal. Her written judgment later circulated and was published in English translation — its criminal constituents remained a blog, articles, and 'being influenced by Xu Zhiyong's thinking.' No outcome of the appeal has been publicly reported; with the sentence itself expiring in August 2024, time dissolved whatever the appeal might have meant.

7. Release, Deprivation of Political Rights, and Status in 2026

On August 3, 2024, Li Qiaochu was released on completion of her sentence. The supplementary penalty — two years' deprivation of political rights — ran from that date to August 2026, during which her rights to vote, stand for election, publish and assemble were legally suspended. Release was not the end of the case: her conviction record, Xu Zhiyong's fourteen-year sentence still being served into the 2030s, and the health consequences of her own detention all continue.

Public information since her release is limited. Reporting in 2026 describes Li, two years after release, still living with the physical and psychological after-effects of detention, and having begun to pursue a formal complaint (申诉) against her own conviction; this page records the point as reported, without embellishment. International attention did not end at the prison gate: rights organisations continued to list her as a case requiring monitoring after August 2024, citing the risks carried by her deprivation-of-political-rights period and her profile.

8. International Response

The international record of Li's case is chiefly one of sustained rights-organisation advocacy. Amnesty International adopted her as an urgent-action case from her 2020 RSDL detention and issued statements at both the December 2023 hearing and the February 2024 sentencing, holding that she had been jailed for running a blog, sharing her partner's articles, and speaking publicly about torture allegations — punished, in substance, for daring to speak. Front Line Defenders, PEN America and CHRD documented and protested each stage — arrest, hearing, sentencing. In 2022 she received a Human Rights Tulip-related award from the Dutch diplomatic mission in China for her human-rights work; when it was presented, she was in a Linyi detention centre.

At the institutional level, the response targeted RSDL itself: at the January 2024 UN Universal Periodic Review, multiple states called on China to abolish residential surveillance at a designated location. Li is both a victim of that system and one of the very few who published a real-name, book-length account of its interior. Her text and her case together are why this archive keeps her file.

Her case was entered by multiple rights organisations and parliamentary human-rights bodies into their registers of Chinese political prisoners and prisoners of conscience, and was raised again at every anniversary of her detention: the February 2021 rearrest, the December 2023 hearing, the February 2024 sentencing, the August 2024 release. For the international record, the case's significance exceeds her own sentence: the indictment's guilt-by-association formula, the first-person RSDL testimony, and a three-year pre-trial detention consuming most of the eventual term make her file one of the most-cited individual cases in studies of how speech is criminalised in 2020s China. This page archives her judgment's key points, her timeline and the international statements by year, precisely to give such citation a verifiable Chinese-language base text.

9. The Institutions on Record

The chain spans Beijing and Shandong. The December 31, 2019 summons and the February 2020 RSDL detention were executed by the Beijing Public Security Bureau, the RSDL site never disclosed to her family. After the February 2021 rearrest the case moved to Shandong: investigation and custody by Linyi police, at the Linyi detention centre and a police-run medical facility (per CHRD); prosecution by the Linyi People's Procuratorate (indictment February 28, 2022); a hearing reported at the Linyi Economic and Technological Development Zone People's Court (December 19, 2023); and judgment by the Linyi Intermediate People's Court (February 5, 2024). Xu Zhiyong's investigation, detention at Linshu County Detention Centre and trial were completed within the same Shandong judicial machinery — two partners' cases, processed one after the other by a single local apparatus.

The case's publicly verifiable documents are: the Linyi People's Procuratorate indictment (February 2022, its core formulations published via Amnesty International and the judgment), the Linyi Intermediate People's Court criminal judgment (February 5, 2024, published in English translation online), and Li Qiaochu's own RSDL testimony (January 2021). Set against them are the documents never published or never received by the family: the 2020 RSDL decision and detention-location record, complete transcripts of the two 2023 hearings, and any ruling on her appeal. The difference in accessibility between the two sets is itself archival evidence of the case's procedural condition.

10. Her Partner's Case: Xu Zhiyong's Fourteen Years (consistent with this site's Xu file)

Li's case cannot be read without Xu Zhiyong's timeline beside it — the two were triggered by the same event and processed by the same local judicial system. Xu attended the Xiamen citizens' gathering in early December 2019; after the December 26 crackdown he went into hiding and was arrested in Guangzhou on February 15, 2020, held first under RSDL and then at Linshu County Detention Centre in Shandong. What Li disclosed in early February 2021 was precisely Xu's situation at Linshu; days after posting, she was arrested and her case was pulled onto the Shandong track. On April 10, 2023, the Linyi Intermediate People's Court sentenced Xu to fourteen years for 'subversion of state power' plus four years' deprivation of political rights; co-defendant Ding Jiaxi received twelve years. Xu remains in prison in Shandong, his term running into the 2030s.

The two cases are evidentiarily entangled. Her indictment opens with 'Xu Zhiyong's girlfriend'; his judgment lists the Xiamen gathering and citizens'-movement organising as the facts of subversion. The blog she ran for him and her disclosures of his prison conditions became her criminal evidence; after her arrest, he lost his most important channel of voice from inside prison. This structure — each held as leverage over the other — is why this site flags it in both files: read either archive alone, and you underestimate the pressure designed into the pair.

11. Her Writings: Testimony, Open Letters, and Writing as Evidence

Li's writings form the other half of this file. First, the January 2020 real-name article criticising her police summons — five weeks after publication she was placed in RSDL. Second, her January 2021 RSDL testimony, a detailed record of 124 days of secret detention — the cell, the interrogations, the collapse of her health — since cited by rights organisations and scholars of China's judiciary as primary material on designated-location surveillance. Third, the series of posts she wrote on bail about Xu Zhiyong's conditions — texts that then entered, item by item, her indictment and judgment. Every step of a researcher's writing was archived in parallel by the case officers, to meet her again in court as evidence.

Since her release she has begun pursuing a formal complaint against the conviction (Section 7). Such complaints succeed extremely rarely in China's criminal process and do not suspend a sentence — hers was in any case already served. The point of the complaint is therefore not the odds of reversal but the record itself: as with her 2021 RSDL testimony, turning experience into text is the method she retains after every formal channel has closed. This archive keeps her file by the same logic: dates, institutions, documents and her own words set side by side, for readers to judge the verdict's quality themselves.

Our Take

Li Qiaochu's indictment deserves verbatim archiving, because it states its logic without embarrassment: she 'is Xu Zhiyong's girlfriend, deeply influenced by his subversive thinking.' A York master's graduate and Tsinghua research assistant was convicted, in the end, for loving a man who wrote articles, publishing articles for him, and writing articles herself. For this she was secretly detained for 124 days, held three years before trial, tried behind closed doors, and sentenced to three years and eight months — most of it already served before judgment. This case never punished conduct. It punished a relationship and a cast of mind: once 'being influenced' is a crime, anyone's partner can be the next Li Qiaochu.
